2. Scope
These Terms apply to all purchases made through the NIGHTMOUR online store.
Mandatory consumer protection laws applicable in your country of residence remain unaffected.
3. Products
NIGHTMOUR offers premium apparel and accessories produced in limited collections.
Every effort is made to display our products as accurately as possible. Due to differences in monitors, photography, embroidery, printing processes, and lighting conditions, slight variations in colour, positioning, or appearance may occur and do not constitute defects.
4. Made-to-Order Production
Every NIGHTMOUR piece is produced after your order has been placed.
By manufacturing only what is ordered, we reduce unnecessary overproduction and maintain a more responsible production process.
Production generally begins shortly after payment has been successfully received.
5. Availability
All products are subject to availability.
Certain collections or products may be released in limited quantities. Once sold out, restocking cannot be guaranteed.
6. Orders
Submitting an order constitutes an offer to purchase.
After placing an order, you will receive an automatic confirmation email acknowledging receipt of your order. This email does not constitute acceptance of your order.
A binding purchase contract is concluded once NIGHTMOUR accepts your order by initiating production or dispatching the ordered product.
NIGHTMOUR reserves the right to refuse or cancel orders where required by law or or for legitimate business reasons, including but not limited to pricing errors, suspected fraud, payment issues, product unavailability, shipping restrictions, export control requirements, or circumstances that prevent fulfilment..

7. Prices
All prices displayed on the website are final prices.
All prices displayed on this website are final prices. Where no VAT is chargeable under the applicable tax rules, no VAT will be shown separately on the invoice.
Shipping charges are calculated separately during checkout.
Customers outside the European Union may be responsible for import duties, customs charges, import VAT, or similar taxes imposed by their local authorities.

Payment is due immediately upon placing an order.

Orders will only enter production after successful payment authorization.

We currently ship to most countries worldwide.
Shipping availability may vary due to local regulations, destination restrictions, carrier limitations, or export control requirements.
Estimated delivery times are provided for guidance only and are not guaranteed.
NIGHTMOUR is not responsible for delays caused by customs authorities, shipping providers, force majeure, or other circumstances beyond our reasonable control.

11. Exchanges
We currently do not offer direct exchanges.
Customers wishing to purchase another size or product may place a new order after completing an eligible return.
12. Product Care
Customers are responsible for following the care instructions supplied with each garment.
Damage caused by improper washing, drying, ironing, or general misuse does not constitute a manufacturing defect.
13. Intellectual Property
All content published on this website, including but not limited to text, photographs, graphics, artwork, logos, product designs, and other original content, is the property of NIGHTMOUR or its respective rights holders and is protected by applicable intellectual property and copyright laws.
No content may be copied, reproduced, distributed, modified, or commercially exploited without prior written permission from NIGHTMOUR or the respective rights holder.
14. Limitation of Liability
To the fullest extent permitted by applicable law, NIGHTMOUR excludes and limits its liability for any damages arising out of or in connection with the use of this website, the purchase of products, or these Terms.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by mandatory applicable law.
To the fullest extent permitted by applicable law, NIGHTMOUR shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of business opportunities, loss of data, loss of goodwill, or other purely financial losses.
NIGHTMOUR shall not be liable for delays, failed deliveries, customs procedures, import restrictions, carrier disruptions, force majeure events, governmental actions, cyber incidents, supply chain interruptions, or any other circumstances beyond its reasonable control.
Customers are solely responsible for providing complete and accurate billing and shipping information. NIGHTMOUR shall not be liable for delays, additional costs, failed deliveries, or losses resulting from inaccurate or incomplete information provided by the customer.
Minor variations in colour, embroidery, print placement, texture, sizing, stitching, or other characteristics resulting from the manufacturing process, photography, display settings, or normal production tolerances shall not constitute defects or grounds for liability.
Except where mandatory law provides otherwise, NIGHTMOUR's total liability arising from any claim relating to an order shall not exceed the total purchase price actually paid by the customer for the relevant product(s).
15. Governing Law
These Terms shall be governed by the laws of the Federal Republic of Germany.
If you are a consumer, this choice of law does not deprive you of any mandatory consumer protection rights granted by the law of your country of habitual residence.
The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply.
16. Severability
If any provision of these Terms is held to be invalid, illegal, unenforceable, or ineffective, in whole or in part, the validity and enforceability of the remaining provisions shall not be affected.
Any invalid, illegal, unenforceable, or ineffective provision shall, to the fullest extent permitted by applicable law, be interpreted or replaced by a valid and enforceable provision that most closely reflects the original legal and commercial intent of the affected provision.
The same shall apply to any unintended gaps in these Terms.
17. Amendments to the Terms
NIGHTMOUR may update these Terms from time to time to reflect changes in applicable law, business operations, or the services offered. The version in force at the time an order is placed shall govern that order.
